MUDA Case Latest News: After not getting relief from the single bench of Karnataka High Court on Tuesday (24 September 2024), Chief Minister Siddaramaiah can now appeal before the double bench tomorrow i.e. Wednesday (25 September 2024). If sources related to Siddaramaiah are to be believed, the CM is preparing for this.
Let us tell you that on Tuesday, a single bench of the Karnataka High Court rejected his petition in which he had challenged the validity of the Governor’s approval for investigation against him in the Mysore Urban Development Authority (MUDA) site allotment case. The court said that the Governor has the right to grant permission to register a case on the basis of a personal complaint.
Will not resign until the Supreme Court’s decision comes
If the CM appeals to the double bench, an appeal can be made to stop the hearing in the lower court till the hearing of this petition is completed. If the double bench accepts the petition for hearing, then Siddaramaiah will get relief. The CM camp has made it clear that if relief is not obtained even from the double bench, then the Supreme Court will be approached and until then Siddaramaiah is not in a mood to resign.
In his petition, Siddaramaiah had said
- Siddaramaiah had challenged the order issued by the Governor on August 17, allowing the investigation under Section 17A of the Prevention of Corruption Act and sanctioning prosecution under Section 218 of the Indian Civil Security Code (BNSS).
- Section 17A provides for investigation of offences relating to recommendations or decisions made by public authorities in the discharge of official functions or duties.
- The chief minister’s petition claimed that the approval order was issued without due diligence, which violates legal requirements and is contrary to constitutional principles, including the advice of the Council of Ministers under Article 163 of the Constitution, which is binding.
- It also said that the impugned order of approval is malicious and is part of an organised effort to destabilise the elected government of Karnataka for political reasons.
